David T. Martin is an associate in the Litigation Group in the Stamford office of Cummings & Lockwood.  His practice focuses on complex commercial litigation in both state and federal courts.  He has represented business entities and individuals in a wide variety of matters, including contract disputes, real estate litigation, noncompetition and trade secret litigation, fiduciary and beneficiary litigation, tax litigation, insurance coverage disputes and creditors’ rights.  Dave’s representative matters include the following:
  • Obtained $5 million arbitration award for client in trust beneficiary dispute
  • Obtained $1.9 million judgment in federal court action for breach of software financing agreement
  • Successful representation of fiduciary in claim made against estate.  Obtained court order denying $1.7 million claim 
  • Successful representation of client in appeal of breach of promissory note and foreclosure action before Connecticut Appellate Court, which upheld judgment in client’s favor
  • Successful representation of automobile dealers in dispute under Connecticut Franchise Act 
  • Successfully argued multiple motions to dismiss employment discrimination actions before Connecticut Superior Court for Fortune 500 company
  • Trial and arbitration experience before the Connecticut Superior Court, the American Arbitration Association and the National Association of Securities Dealers Dispute Resolution, now merged into the Financial Industry Regulatory Authority
  • Representation of a variety of types of companies including large corporations, closely held companies and hedge funds in business disputes, including enforcing employee non-competes, unfair trade practices claims, trade secret litigation and alter ego claims
  • Representation of multiple Fortune 500 companies in personal property tax appeals

Dave is a member of the bars of the State of Connecticut and the State of New York, and is admitted to practice before the United States District Court for the District of Connecticut, the District Court for the Southern District of New York, and United States Court of Appeals for the Second Circuit.

Dave received his B.A., summa cum laude, from the University of Pennsylvania, where he was elected a member of Phi Beta Kappa, and his J.D. from Fordham Law School.  While at Fordham, Dave was a member of the International Law Journal and the Fordham Moot Court Team.  He coached Fordham's Constitutional Law team to a national semi-finalist finish at the William B. Spong Moot Court Competition.

Dave is a member of the Connecticut Bar Association, the Raymond E. Baldwin American Inn of Court, and the University of Pennsylvania Alumni Secondary Committee of Fairfield County.
